This is to bring to your attention that we have been facing the problem of water sepage in our Flat No. C-1103 since past one year. The same was brought to the notice of Maintenance department through several written complaints. And in this regard Mr. Kalicharan was also informed and he assured us to get it repaired within a few weeks, but now more than 6 months has been elapsed, no action is taken till now and the house looks messed up as the sepage is there in 2 bed rooms and also in living room.

On making him several requests he visited our house to see how bad the water sepage problem is, still his attitude to get it repaired was extremely casual and he did not seem to bother about his duty to get it repaired.
Whenever we called him up during the past one month his reply was within 1 day he will get the work started and gave several excuses and very patiently we waited.
Now it doesn't looks like waiting is worth the results, as he is just making a mockery of the problem. Perhaps he feels nobody is there above him to question his way of working.

I request the respected office bearers of RWA to kindly look into the matter, so that people like Kalicharan gets accountable for the job, and the problems of residents are being taken care of without any negligence.

We wish to inform you that the members of our RWA, in the EGBM held last Friday, have approved the proposal of rolling out changes in the service levels on trial basis for 3 months and thereafter determine the charges accordingly. It was indeed very tough for us to convince the residents as they were very apprehensive of the approach and quality of actual delivery by SML, given their past experience of so many years now. We will shortly prepare a detailed MOU in this regard as agreed in our meetings. In the meantime, kindly arrange for rolling out the processes of negotiations with vendors / effecting necessary changes so that the trial process can be commenced with effect from 1 April 2011.

In reference to the issues discussed in the meeting held on 26/02/11
minutes of the minute as actions to be taken from our end are:

1. The pit in question gets its outlet waste from other non-Yashoda
Hosp origins also. However, Yashoda authorities would take action to
see that the same pit would be dealt with by shifting it out from the
basement parking area in Supertech. The Civil Work for the same has
started from today i.e. 28/02/11.
Since, we have taken the necessary action from our end, we are looking
forward to start the repair work of the pipes/ ducts form 01/03/11
without causing any inconvenience to the residents.So, kindly do the
needful in this regards.

2. All biological and medical waste is already being disposed off
separately as per the regulations, in colour coded bags through a Govt
authorized agency which is contracted to clear the same from within
the Hospital premises regularly every day. As regards the disposal of
the other non biological & non-toxic food & general waste, it is being
coordinated with municipality on a regular basis. However, a proper
storage avoiding any spillages will be ensured. Also, its storage
till clearing by the Municipality would be regulated in a more orderly
fashion.

3. It will be ensured by putting in situ, a hostel warden who will
regulate the hostel activities in an orderly fashion. He will also
ensure that the cleanliness and visiting of unauthorized persons if
any will be controlled on a daily basis by the designated hospital
staff.

4. This problem can be properly resolved by all concernedby taking
measures as to not disposing garbage in the balcony and only through
proper hygenic methods. However, joint visit with the RWA members will
be made as soon as possible to look into this issue.Let us know about
your availabilty for the same.

5. The Oxygen supplier has been intimated with immediate effect to
supply the cylinders only well before 10pm in the nights and only well
after 10am in the day times, to avoid inconvenience.

6. The said area unfortunately belongs to the Municipality the
activities of which the Hosp has no direct control over. However, the
Hospital will coordinate with the parking agency & organize the
parking in an effective manner.

7. T o look into the technicality of this issue Blue Star Engineers
has been called on 28/02/11 to visit the site physically and give a
proper resolution for the problem.

We hope for cordial relationship in the future without the need of any
middlemen.

Dear Mr. Garg,

This is to bring to your kind attention that complaints regarding maintenance for my flat - OA 303 which are as old as since the time of possession in July 06 have not been attended satisfactorily so far.

My complaints and follow ups with your team have fallen to indifferent attitude and all chasing up has gone into vain so far.

Please refer to complaint log at SRORWA web site for your easy refernce.

The attitude of your maintenance team has been that let the person keep on chasing and one day he would get frustated and get the job done himself. I have done it in past but moving forward I intend to debit SML for the expenses incurred.

I have held back maintenance charges because of this deficiency and indifferent attitude of your team. Please note that if all my complaints are not addressed to properly ( not a superficial job but after analysing root cause and bringing about correction accordingly ) by 15th Dec 2010, I shall be engaging third party for this and would adjust my outstanding maintenance account money against this.

This however would not absolve Supertech or SML of deficiency in the services and poor workmanship of the flat. In case after engaging third party to carry out repair work, problem persists, I shall be debiting SML against maintenance charges.

It is pertinent to mention that the termite have entered into my kitchen after damaging the kitchen window and has spoiled my newly made modular kitchen cabinets.

M/s. SML has sent me a Legal Notice, in response to my letter requesting M/s. SML to complete the following pending work in my shop :

1 The area of shop purchased by me is less 4.37 sq.ft.

2 They have agreed to provide water connection in my shop and accordingly I have sent the cheque. They have started the work & stopped the same in mid and returned the cheque to me.

3 While providing the water connection, a marble slab was broken which has not yet been replaced.

It is further added that I retired from B.R.O. during September 2003 and booked a shop during April 2004 keeping in view to start some business to cope up with the financial crises. The shop was supposed to be given on 31-03-2005 but the same was handed over to me during 2007, that too, after approaching the state's officials.

M/s. SML continue to harass me and keeps on spreading bad words about me. Really, it is a Monoply of the Builder.

Further to the legal notice of M/s. SML, I have made attached reply to their false & baseless legal notice.

Mr Kalicharan had been given false promises since last few days and work is still pending.

Moreover he has misbehaved with my wife when she visited his office this afternoon, requesting him to send staff to get the job done and questioned the reason for delay. He argued that it is not their job and we should rather consider it as a favour to us by Supertech ??

When asked why did they have started the job when they could not complete it in time ?? he argued that they have other jobs to do also other than of ours ??

Would like to request you to please forward this mail to their seniors, especially Mr N K Garg since we don't have his email id.

We would request RWA support to get justice and get our work completed in time.

Just see the twist in the Sequence. This morning , on inspection of the RO water Tank near C3 Block ,

undersigned wittnessed, the direct supply of Ganga Water in RO water Tank, whereas this RO water Tank

is for storing RO water,to be pumped to overhead tank. The Security Guard at C3 helped me in opening the

lid of the RO Tank.as the same is quite heavy.

( Now what , can we say of Quality ......)

I do not know with whose permission, it is being done, but is quite clear, that, all action is channelised, in

compromising all issues & facilities related to welfare , Hygiene and Safety of residents.

As such , it has already been highted to you that ,Dengue cases has been reported in SRO, and with this........

I do not know, what all need to be monitored by Residents.... Such Hue and Cry has been raised by Residents

for Quality of water but no attention by M/s SML has been paid to it.

It seems we have reached the ...WALL.

One side your assurance and other side such Incidents is still happening. What can one infer from this.

We all are aware of the fact that very soon two AHU will start functioning from our basement parking.

There are many Health and safety hazards caused by these units that includes fungal & bacterial infections along-with Fire.

Few of them are mentioned below;

To prevent fire hazard there has to be a automatic fire alarm operates, the respective air handling units of the air conditioning system shall automatically be switched off to prevent fire from spreading in the building

AHU should be in sound proof rooms to prevent noise pollution

Building permits and code-compliance inspections of the installations are normally required for all sizes of buildings

Central, 'all-air' air conditioning systems are often installed in modern residences, offices, and public buildings, but are difficult to retrofit (install in a building that was not designed to receive it) because of the bulky air ducts required. A duct system must be carefully maintained to prevent the growth of pathogenic bacteria in the ducts

Accumulation of dust, grease, debris etc. are very common around the AHU, should be cleaned regularly

Inspection at short intervals are needed for AHU installed for ventilations of kitchens in professional use as the components required frequent service, maintenance and changing to avoid fire in such .

Attack of the Toxic Air Handler

There's an old saying about water, shared among health-conscious people: If you are not drinking filtered water, then you are the filter.

Recent

When you apply that proposition to the air circulating through buildings, you may think there's no problem because the air is filtered or cleaned by the building's air handler. But in many cases, that may not be true.

If a building's air handling units have a clogged, leaking or poorly draining condensate pan, this creates the perfect breeding ground for molds, fungi, bacteria and other biological contaminants that circulate continuously within the building's air and the lungs of inhabitants. And if the problem isn't solved, it likely will intensify.

Why are such air contamination problems so widespread in today's buildings and seemingly worsening?

“Since the 1970s, architects have been designing buildings that are more airtight, to help prevent energy leakage,” explains Dan Maser, president of Enviroair Consultants Inc., a provider of industrial and commercial hygiene, safety and environmental services. “And because of that, we're relying totally on the air handling system to bring fresh air into the building. But if the air handling system has a malfunctioning condensate drainage system, it can become the source of biological contamination. Moreover, that unhygienic air may continue circulating, undiluted.”

Maser, a certified industrial hygienist with over 30 years of experience in the fields of environmental, fire protection, industrial hygiene and safety compliance, knows that the likely culprit in such air contamination cases is the air handler's condensate pan or “drip pan” that is supposed to catch condensation moisture released from the air handler. It is vital that the condensate pan provide for proper water drainage. Yet, having conducted many indoor environmental air quality studies and consulting on bioaerosol cases, Maser knows that air handler condensate pans can be poorly designed or inadequately serviced.

Essentially, the molds, fungi and bacteria that plague building air systems requires only three things to propagate: the right temperature range, a source of sufficient nutrients and water. Malfunctioning condensate pans generally meet all three requirements.

“In the presence of stagnant water, the dirt that is normally present in an air handler is a food source for various biological agents, not only molds and fungi, but also strains of bacteria,” says Maser. “And because you have this continuous moisture content, you get unwanted and possibly unhealthy biological growth in the pan, which could eventually cross-contaminate the ductwork and possibly even the filters.”

Maintaining the cleanliness of the system is crucial. A key point is to reduce manual efforts required to help maintain the air quality in the building.

BEYOND MAINTENANCE COSTS

Obviously, the problems with air handlers made toxic by leaking, clogged or malfunctioning condensate pans go far beyond maintenance costs. In addition to that issue come several others, such as business disruption, the reputation of a “sick building,” rental of temporary HVAC equipment and potential for liability for health issues.

Maser points out that Aspergillus is one of the fungi that have been documented to cause issues in hospitals and other healthcare facilities. If Aspergillus is present in the air handling unit, it may further compromise people who are ill or elderly by exposing them to these agents when they are more susceptible to infection. [Note: This is not a reference to the transmitting of communicable diseases in healthcare facilities.]

In addition to allergic reactions and other health issues, a “sick” building caused by air handlers with stagnant water due to leaking or clogged condensate pans can make building inhabitants feel tired or lethargic.

The residents have read your email with lot of interest. However, the residents wish to reiterate their decisions regarding ducting in basement as articulated in our earlier emails. It is really frustrating to observe that despite our written objections to these illegal activities, you and your company are still continuing with the same in residents' basement without even discussing with them which clearly shows that you and your company do not have any regard for the laws of this country. We have already mentioned that you and your company are doing all these illegal actions on residents' properties without taking any permission from the residents. In our civilized society, we regard this as 'goondagardi'; and you are talking about considering residents' interest? How will you feel if the residents intrude your home and install ducts on the ceiling over your head and tell you that we will keep your interest in mind so that you do not have any inconvenience in moving within your house? Please note that we still have rule of law in our country. Are you testing the patience of all residents? As already communicated, the residents will take a decision on this weekend as to how and at what level the matter will be taken up with the District Administration if such trespass is not immediately stopped. The responsibility solely lies with you.

As regards installation of cables and pipes etc catering to residential areas, we have already written to you several times in the past that such lower height has to be corrected by your company which you have never responded to. In any event, since the area belongs to the residents, they are free to allow such installations catering to residential areas and this cannot, in any circumstances, be taken as a license to SML for free use of the area for any other purposes whatsoever. We hereby ask you as to on what basis you want a right to use our basement solely belonging to the residents for any commercial purpose? What charges you and your company propose to pay to RWA for grant of such usage by the residents? What security deposit amount SML is prepared to pay to RWA towards safety of residents' vehicles and damages to the basement as such? What amount of indemnity SML would agree for any loss/damages to be cause to the residents and the entire building arising out of such illegal usage of basement? Please also let us know what amounts you are charging from all commercial occupants for usage of our basement and other residential common areas and how much money SML is making by allowing such usage of the property sold to the residents?

The residents also wish to convey to SML that they have lost all faith and trust in you and your company long back and, hence, please do not make a false statement that SML cares for the interest of residents. This is very clear from the arrogance and the manner in which SML management and staff come across the residents. If SML really cares for residents' interest, then why it never talks to the residents before taking decisions or actions affecting the lives and properties of residents? Can you please show us a single email/correspondence where you/SML on your own have proposed a meeting to resolve any problem being faced by residents?

Regarding the independent issue of maintenance charges, we ourselves had come forward to help SML improve the services and had countless meetings with your management wherein many decisions were taken and your management had agreed (everything is documented) to implement a whole list of long pending items along with transfer of agreed degree of control to RWA based on which it was agreed to consider revision of charges. However, you have cleverly chosen to implement only one decision that is to increase power backup charges from Rs 8 to Rs 12 per unit. On the other hand, your have always very conveniently not even acknowledged so many emails/correspondence reminders sent by RWA on other items leave aside implementation of same. Now you have again unilaterally tried to further increase power back up charges by 70 paise without holding any discussion with the RWA which is unacceptable to the residents for the reasons already explained in our earlier email and we expect you to immediately issue corrected invoices.

You are also aware that the Ganga Water supply to SRO was disrupted for last 7 months because of metro rail work being carried out by DMRC and the RWA had made repeated requests to the management of your company to get the water supply restored. However, your company, which is solely responsible for the management and maintenance of all water supplies to SRO, did not act at all at any point of time nor did it ever respond to RWA requests in this regard. Ultimately, the residents themselves did all running around and follow up with numerous authorities like DMRC, GNN, GDA, District Administration and GNN Contractor etc for past 3-4 months and got the water supply restored very recently on 11 August 2010. Can we ask what kind of "services" you are providing to us for which you are asking maintenance charges? Further, in the above entire process for restoring water supply, the residents have incurred huge amounts of time costs, resources and money. How do you and your company propose to compensate the residents for such costs incurred by them?

The residents reiterate that in view of all the above reasons payment of maintenance charges to SML without any service is a huge loss to them. The timeline of further 30 days given to SML to correct its way of working is also running out fast.

Independently, we have already informed you that a meeting of all residents of SRO was held few weeks back wherein detailed discussion had taken place inter alia on all issues relating to the countless issues/problems being faced by the residents as well as the issue of revision in maintenance charges. In the above discussion, the residents were of the following views unanimously:

1. That all residents are absolutely displeased by the fact that you have not addressed/resolved even a single item out of countless matters/complaints referred by RWA/residents from time to time during 4 years.

2. That the conclusions arrived at by the core committee in its report on joint study are very rational and based on scientific approach and hence the recommendations made therein must be adopted and implemented with immediate effect.

3. That the residents do not agree to pay for any losses purportedly being incurred by SML owing to its own inefficiencies/deficiencies/theft/defects in its own working systems as the residents do not have any control over the affairs of SML nor do the residents agree to pay for any unnecessary costs (having regard to usual commercial prudence) being incurred by SML which are of no benefit to the residents.

The residents also wish to state that the rate of maintenance charges of Re. 0.81 per sq ft/pm arrived at in the aforesaid core committee report should be taken as final subject to the following further adjustments:

1. Deduction on account of interest income being accrued to SML on the present value (after taking into consideration normal FD interest rate of SBI) of the aggregate amount of maintenance security deposits given by all residents at the time of taking possession of their flats. This is for the reason that we are now discussing revision of the maintenance agreement.

2. Deduction on account of justified allocation of all revenues being generated by SML/Supertech from all advertisements/billboards/signboards displayed at all areas (including rooftop) of the SRO residential complex.

3. Deduction on account of charges/costs at mutually agreeable rates in respect of usage of common/other areas of SRO residential complex for all installations/facilities/other usages catering to commercial complex/mall and Yashoda Hospital.

4. Addition of 10% on the final rate as arrived at above towards SML management charges and other costs etc.

We have also delivered a detailed letter dated 10 August 2010 to your staff at SRO. A scanned copy of the acknowledged letter is attached with this email. The residents expect immediate action of SML on the points raised in the attached letter.

The core committee is in advisory capacity only and the final decision / action has to be taken by the RWA/Residents collectively. This position has been very clear also from the deliberations that took place in last GBM as also in residents' meeting held prior to this GBM. The committee had prepared the draft letter attached. The committee had recommended to RWA that the last paragraph of this draft may be suitably modified (as per the decision of the RWA/all residents) and then the letter be sent to the builder. Please count me in for the ensuing litigation. The said recommendation stands subject to residents' approval. Also, we recommend that all actions /communications addressing the builder should be in writing apart from other actions/communications.

Further, your email should not have been copied to NK Garg of SML which has the effect of weakening our position. I think it happened inadvertently.

We all know about the pathetic response time ( if at all response is given ) by the builder. As conveyed in GBM, there is nothing which builder is providing as service. Carpenter has not come for months together, security is in shambles, complaints are attended ( if at all ) as per convenience of the builder.

I share concerns of Mr. Shanti Swaroop and I am in agreement with him that we should ask builder to come down to a cost of Rs. 0.40 rate immediately.

Further, not all of us are as diligent as Mr. Shanti Swaroop who has kept record of the complaints.

Many a times complaint made to maintenance office are not even logged in the complaint register. I would suggest that we should start a complaint log in SRORwa web site and let builder take a print of it every day and once complaint is resolved he should get it signed from resident. Let builder pay for any charges which are incurred in developing and maintaining it on web site. This would take care of smartness of maintenance staff and further they would not be able to say that last complaint register is lost ( as they have said quite a few times.

M/s Surya Merchants Ltd. wants to increase the Maintenance charges but COMPLAINTS are not being intendingProperly. So we must consider reducing the maintenance.

It is submitted for the information of all residents that I had spent Rs.3.25 Lac. For renovation of my flat No 802-OA during 2008. Prior to this, I had requested M/s SML/ M/s Supertech Rameshwar Orchids to appoint Arbitrator as per agreement to sell. They remained silent then I requested to inspect the site JOINTLY but they remained silent. Owing to their silent, I had lodged Court Case in Hon,ble Consumer Redressal Forum GZB

Now M/s SML is stressing to increase the maintenance charges where as they are not looking the complaints of defects properly. Instances are appended below:-

Mr. Lalit Sharma have physically checked the site on 02 Jan 10 and directed Mr. Kali Charan to complete the job. But the job has not yet been carried out completely. On 12-03-2010 a complaint was also made and a painter was provided who left after doing some works. On 11-04-2010 again a complaint MADE and a painter was provided who too left after doing work in bed room only. He took Rs.40/- from me for purchase of colour and shade applied on the wall of master bed room does not tally with the existing shade. Balance works have not yet been carried out.

Besides complaint for mason ( for patchwork 10"x2"plastering )and carpenter ( for adjustment of modeler kitchen accessories ) were lodged on 12 Jun 2010. Even these works were told to Mr. Kali charan who promised to do these works with in 2 days but no progress as yet.

More so the Std of domestic water is not good. Builder has just got bore-well diged near to old bore well and not bothered to install filter.

For RWA only :- please take up the matter with builder on priority. It may please be noted that our complex is in very pathetic condition at present. Besides M/s SML wants to increased the maintenance charges where as maintenance condition has gone from BAD TO WORST. Please ask BUILDER to start recovering Rs.0.40 per sqft only from 01 Jun 2010.

We all know about the pathetic response time ( if at all response is given ) by the builder. As conveyed in GBM, there is nothing which builder is providing as service. Carpenter has not come for months together, security is in shambles, complaints are attended ( if at all ) as per convenience of the builder.

I share concerns of Mr. Shanti Swaroop and I am in agreement with him that we should ask builder to come down to a cost of Rs. 0.40 rate immediately.

Further, not all of us are as diligent as Mr. Shanti Swaroop who has kept record of the complaints.

Many a times complaint made to maintenance office are not even logged in the complaint register. I would suggest that we should start a complaint log in SRORwa web site and let builder take a print of it every day and once complaint is resolved he should get it signed from resident. Let builder pay for any charges which are incurred in developing and maintaining it on web site. This would take care of smartness of maintenance staff and further they would not be able to say that last complaint register is lost ( as they have said quite a few times.

M/s Surya Merchants Ltd. wants to increase the Maintenance charges but COMPLAINTS are not being intendingProperly. So we must consider reducing the maintenance.

It is submitted for the information of all residents that I had spent Rs.3.25 Lac. For renovation of my flat No 802-OA during 2008. Prior to this, I had requested M/s SML/ M/s Supertech Rameshwar Orchids to appoint Arbitrator as per agreement to sell. They remained silent then I requested to inspect the site JOINTLY but they remained silent. Owing to their silent, I had lodged Court Case in Hon,ble Consumer Redressal Forum GZB

Now M/s SML is stressing to increase the maintenance charges where as they are not looking the complaints of defects properly. Instances are appended below:-

This is to inform to all the hon'ble members of Supertech Rameshwar Orchids about the supply of Ganga water issue to our premises.

For restoration of supply of Ganga water to our premises, I telephonically contacted DMRC (Delhi Metro Rail Corporation) site incharge and requested to restore the supply urgently. I also informed that due to non supply of Ganga water, we are presently forced to drink sub-standard water leading to the health complications of residents. The DMRC official suggested to immediately submit our request in writing alongwith all the details i.e. the period/date of stoppage of supply of water to Supertech, the Supertech water supply connection number, the location/ site of disconnection of water supply line etc. I have requested Mr. Kalicharan several times to provide me the above details so that a letter can be written to DMRC for this purpose. But till date, despite of several reminders, I have not get any information from Mr. Kalicharan.

This is to draw the attention of the President and the General Secretary of SRO as well as all the members concerned that the quality of RO water is still the same that was earlier. If nobody is taking any note of it and is still consuming the same water, then it is a different matter altogether. I remember that on the day the last GBM was held, we all had met Kalicharan and it was clearly told to him to change all the filters and that if the builder is unwilling to change it, the RWA will bear the cost initially, which will later be recovered from the builder. But still nothing seems to have happened. The builder has also been served a notice, but has anyone of us seen them taking any initiative as yet? What will they do in the next few days? Now I don't know what we are waiting for? Are we so poor that all of us together can't buy a few water filters for the sake of our own health? I am sorry to say but this puts us in very poor light.

Also, while all initiatives are being taken to improve the security around the A Block parking lot, nothing is being done about the security of the C Block open parking. Strangely, no security guard remains present there either during the day time or during night, and it is only by God's grace that our cars are not being stolen from there. But how long can we allow this go like this? If the builder had informed us earlier that they will give the open parking virtually on the road and with no security, then we would probably have booked covered parkings instead of the open ones. But nothing can be done now as it is too late. Does that, however, mean that we should accept that as our fate and do nothing?

Find enclosed the picture taken today- RO water filled in white bucket. You can see very well yellow deposit/ colour of water, it seems the second filter is not yet changed.

Dear Mr Singh and Mr Swaroop

As decided in the last GBM, kindly immediately call a meeting of all club members to discuss and decide on the course of action on the issue of non-provision of club facilities by the builder.

It appears out of discussions in the GBM that the serious issues relating to the following are also involved- (i) use of so-called club facilities by non members and outsiders and collection of money from them by some elements (ii) security and safety issues arising from above and (iii) showing of huge amounts of arrears in the maintenance bills of residents in the name of club maintenance charges by the builder with certain ulterior motives though the club itself does not exist leave aside its maintenance and that too by a notorious agency like SML. In view of such larger issues concerning all residents, the meeting should be called and conducted under the aegis of the executive body of RWA. Since the time is running out fast and we have never taken any action on above, the meeting should be called on an urgent basis.

The GBM has given clearance for stopping of maintenance charges from 30.06.2010, however

the RWA keeping in view the numerous pending points to be attended by M/s SML, has

given cutoff date from 15th July,2010.

The above is for kind information of all the Residents and there further necessary action ,please.

We regret to again inform you that the Revised date of RO water supply for Monday Morning i.e 14.06.2010

has again failed, and that too again with no information.

Further the C3 Main Gate pillar ,has yet to be attended. It seems the Gravity of Issue is not being understood

by M/s SML. The Residents are very upset because of the same...............

What kind of attitude is this... as it seems M/s SML, is least bothered about the Life, Safety and well being

of Residents of SRO..

If this is the approach then what is the Logic of bringing things to your notice...............

rectify the problem at earliest. The whole RO Plant is going to be serviced.

PS: Further as per the Notice Put by M/s SML,

A: that Domestic Water Tank will be cleaned, and if you see the Quantum of Muck which has been taken

out from tank is mind Boggling. The same is still lying around the inlet of the Tank.

B: RO water Plant was to be repaired on top most priority and Water supply has been discontinued since

8th evening onward. but to be resumed positively on 11th morning. We have yet to receive any confirmation

from Mr kalicharan regarding the pace of work. If tommorow RO water is not supplied, it may create a lot

of hue and cry from the Residents, as thay must have planned as per Notice put on Notice Board by M/s SML.

Understand from maintenance staff that RO water supply may not be resumed today and it may not be possible for them for a next few days also ??? They are not able to provide any fixed date for same as of date ??????

Also Understand from Mr Sharad Singh that Surya Merchants have almost opened RO plant completely and are not in position to give any date on which it will be reinstalled and will start working.

Keeping in view above circumstances may I request all of you concerned to take it up with RWA committee to ask Surya Merchants to pay at least cost of one bottle of drinking water can of 20ltrs...approx. Rs.70/- per day per flat till their RO water supply is resumed
OR
ask them to arrange drinking water cans on their own in bulk quantity and supply one such bottle of 20ltrs. per day per flat.... so that they can get good quality branded water at reasonable price from market...brands to be considered to avoid any further issues related to quality of these bottled water can be....KINLEY, BISLERI etc.

Till we take such initiative and ask them to pay for bottled drinking water this type of situation will prevail and they will keep on taking us for ride.....and we will be rushing to & fro to purchase cans on our own for no faults of ours.

At same time would request respected RWA members to take it up with residents by way of putting notice or calling each of them on their extensions or calling urgent meeting for same in the late evening and inviting consensus on same rather than waiting for getting individual complaints from residents for same.

As suggested by Mr. Shanti Swarrop we should plan for going to Builder on coming Sunday to highlight all the problems faced by the residents. We should also intimate to the builder that we are going to stop the Maintenance charges untill unless Security , Housekeeping and Water problem gets resolved.

In addition to this we should also review the design for the emergency stairs(exit) which is being placed in the wing-A, rather than blindly believing on the builder. This is going to be another security concern in future and improper design could lead
to ventilation and bad light prolem for X04,X05,X06 flats.

Dear All

The state of Security and house keeping staff for about 40 days is appended herewith.

It can be seen that Gun Man has remained absent for so many days & night. Strength of security guard is very inadequate on so many days.   How can 2 - 4 guards can protect the complex during night.   It is clear that M/s. Gobind Guard is certainly playing with the life/property of residents.

Recently one car has been stolen from 'C' wing on 21-05-2010.   Yesterday i.e. 04-06-2010 at about 2100 Hrs. a car has been stolen from parking of Wing "A".

Now the time has come that we must get this security and house keeping staff changed immediately.

It is added for the information of all that during meeting with Builder on 06-01-2009, it was agreed to replace Security as well as Housekeeping staff with in 2-4 weeks but nothing has happened so far. It has been experienced that Builder is not responding to our correspondence so it is of paramount requirement that we (maximum) residence should go to Builder collectively and get the Guards (Security Agency) changed immediately.

1. Now time have come when we should start agitating against the monopoly of Builder.
2. Kindly offer your views on my suggestion.
3. There are instances when Supervisors are performing their duties continuous 2 to 3
     shifts (about 36 hrs continuously)

The Domestic water too has so much of Salt content , that which will be health Hazard for the residents , as well as the RO water is also of very poor quality , as couple of Jaundice cases has been reported from SRO. Even Joint inspection of SRO with Mr lalit Sharma, as deputed by M/s SML, has failed to get the SRO work in progress, as lot of assuarance was given that things will be done on priority, but its status Quo. We need to Quantify the Monthy Maintenance Paid against Quality of services provided. Meeting with M/s SML, has yet to show positive pace, as even though its assured in every meeting but the same does not translates into concreate output.

Present Situation is of great concern as residents are regularly complaining for the same, and we need
to address their Grieviances. We need to meet , on top most priority.

The senior most Member of RWA was asked to shoulder the responsibilities of RWA in MOM dtd 09.05.2010, which had consensus of all members present in the meeting. He was clearly told to arrange a Extra Ordinary GBM for 16-05-2010 as approved in the executive body meeting on top most priority. Few Hon'ble members have failed to abide the directions and as such slipped from the path and started calling meetings with different aims resulting in the present situations.

Hon'ble residents have started exchanging their VIEWS in Blogs www.srorwa.org. and indulged some in facts and some indulge in superfluous correspondence stating mud throwing, some states "Angoor Khate Hain", some states "Okhali Me Sar Dala Hai To Musal Se Kyaa Ghabrana" etc. What fruitful result can be achieved by indulging in such superfluous Correspondence.????

Had the Treasurer taken a correct view as agreed by all and requested to call a GBM for 16-05-10 and get the resignation of both approved,tthe matter could have been solved for ever. Whereas Present RWA has not called the GBM which was approved by 14 Hon'ble Executive members, rather finalized the election for 11-07-10 when only 7 executive member + 3 Club/Core committee members attended the meeting on 15-05-2010. As per bylaws of SRORWA vide Para 7(b) Election (1) clearly states that " Election SARVANG ANUMATI and Gupt Vote " In view of this clause,present members can not finalize the Election. This is required to be approved in the GBM first.

It may please be noted that resignations are required to be approved only in GBM

Now the Hon'ble residents have to consider the correct measures, instead, requested to avoid unnecessary correspondence in Blogs.

Although i could not understand your mail, but what i presume you wanted to say is that i attended 2 meetings which were not as scheduled.

Please let me put the facts correct -

The meeting on 9th agreed that the GBM should be held on 16th, but we also agreed that yours and Gen Secys resignations will be discussed and if need be accepted only in the GBM. Surprisingly on 10th you and Gen Secy send in the minutes of the meeting which were very contradictory to the actual discussions and also state that since we both have resigned , the RWA will now be headed by the Treasurer.

Now if the Treasurer calls for a meeting i had to attend the same as he was the authority to call for the same ( as per your minutes of the meeting ). So dont blame me and others for attending the co called meeting which may be unconstitutional in your eyes.

As i have already put in my previous mail, stop putting the blame on others and accept the fact that yours and Gen Secys hasty resignations have put the RWA and the building at large in a spot of bother as it is today .

Still the situation can be redeemed if we all work together for the betterment of SRO, otherwise the builder will have the upper hand and the SRO will go from bad to worse.

I think they are deliberately avoiding this. Particularly Raman doesn't want that any of our problems should be solved. He is already spreading rumours that we don't pay maintenance. But he never tells anyone that despite my repeated attempts and letters written to the Supertech management, the builder has till date not paid the penalty (for the delay in giving the possession of the flat) due to us, which in any case would be more than the maintenance amount due. And till the penalty amount is not cleared, I am certainly not going to pay the maintenance. If anyone has any problem regarding this, I invite them to talk to me directly. MARD HO TO MARD KI TARAH SAMNE AAO. Why this back-stabbing?

And so far as the problems regarding the common area is concerned, no one can deny solving it. Today we had to remove the water from the corridor all by ourselves, otherwise the water would certainly have entered our house. Now I don't expect any maintenance staff to come to our help. But remember that just after some time NOT ANYONE OF THEM would be needed at all. Just wait and watch! It is a gentleman's promise!

Sharadji, I concur and have the same opinion on the current scenario. In addition, I am very sure that the joint secretary as well as other participated members will not reply you on this mail.

Why I'm so sure because I have not received any reply against my mail to Mr. Bangia and Mr. Arya on 14^th may, which was clearly indicating that the agenda of so called extra ordinary executive body meeting was already discussed earlier on 9^th may.

All presented members including joint secretary, treasure and jt. treasure were agree for the GBM on 16^th then why there was second thought.

As per my opinion, the resignation of VP and GS is still on hold and under consideration since there is no call for GBM. Once decided on ninth may that the GBM will review their resignation then how a further executive body can accept their papers.

What was the emergency behind this decision???

SO, I APPEAL TO GEN. SECRATRY AND VICE PRESIDENT TO CALL SCHEDULED GBM AS SOON AS POSSIBLE.

Decision on election between few executive members opposing RWA law, Clause 7(b) which clearly instructs us that election should held with "Sarvant Anumati".

But, I don't see the "Sarvant Anumati". Can any resident who has relevant legal knowledge put some light on this clause?

Today I went to the swimming pool and found two things very strange: -

1) Outsiders (non members) were swimming in the pool without swimming costumes - Some 5 person were swimming in the society pool without swimming costume. When i asked the guard posted at the gate of the pool , the guard replied that one of the 5 person was Mr Sushant of A-Block. The entry was there in the pool register. I forgot the number of the Flat. Four other person were friends of Mr Sushant. Guard also informed me that Mr Kalicharan has made the card those in Rs 2400. This is really strange and needs to be looked into very urgently.

2) The Changing Room Door cannot be closed and the tube lights are not working and even the cleanliness was missing.

Respected Srivastavaji,

I think you are only wasting your time if you expect the residents of Supertech to unite and do something for the welfare of our own society and fight for our own cause. Strangely, here people seem concerned only with their own flats and welfare, having little or no concern about the welfare of other residents or society. If it were not true, then how come the state of our society has come to such a sorry pass – that too in just about 4 years? And the wonder of all wonders is that a majority of residents are still enjoying a sound sleep in their home! May be they believe that if something happens to our building, their home and family would still be safe!

Don't wonder. This is the typical thinking of us Indians. That is why we pay no attention to people in distress or even those dying on the road or being murdered before our own eyes. We always think that bad things and misfortunes are meant only for the other people, while nothing wrong will ever happen to us. But, alas, that could be true!

What surprises me most that just mention the name of the builder and say anything against them and there are many residents around us whose blood gets boiling as if the builder were their MAAI-BAAP! On the other hand, there are many residents who prefer to keep mum and look the other way as if they are employed by the builder and the builder would kill them if they utter a single word against them. Are you expecting these people to unite and fight back?

I am sorry to say but we really seem to have forgotten the saying that BRAVE PEOPLE DIE ONCE, BUT COWARDS DIE EVERYDAY!

hi all,
Supertech is now promoting a new tower in livingston which was not in the original plan that was printed in ts brochure that was circulated to buyers and also in its website.this new tower is right in the middle of the project where earlier a green area with a was proposed .this ia a clear case of cheating by the builder and i would like to bring this to the notice of all those who have bought a flat in Livingston and particularly towers E F B and C1 and had taken the park facing flats and paid PLC for that.I request u all to lodge your Protest with Supertech to stall this alteration immediately before it its too late.

Thanks for pointing this out. It is very unethical of the builder to change plan without intimating customers who have bought flats based on original plan. This indicates lack of transparency from their side which is not a good sign for the existing customers. I too will protest at this arbitrary change in plan .

It was 15 days back when we had first complained about seepage in our bathroom. It took them 7 days to bring a plumber at our doorstep. After his appraisal of the situation, the department promised to rectify the situation within a few days. 7 days have already passed since they last contacted me but with no avail. Consequently, the seepage in our house has gone from bad to worse.
